thanks for the help here, yes a couple of my old BEs. which I need to keep for now were the trouble.

brief synopsis of what I did , jsut in case it is helpful to someone else.

zfs list 
zfs set mountpoint=/mnt1 rpool/ROOT/b98
zfs mount rpool/ROOT/b98
zfs unmount rpool/ROOT/b98
zfs set mountpoint=/ rpool/ROOT/b98
zfs list
zfs snapshot -r rpool at snap

rinse, repeat for each offender found in the logs.

svcadm clear frequent daily hourly weekly
svcs auto-snapshot

tada , a nice lifesaver icon loses its grey and five snapshots.  thanks again
