I just ran into this or a similar bug on 2008.11:

In my situation, the zfs filesystem was not the root filesystem, but the 
end result was the same.  The workaround of copying /dev/null onto one 
or more files, then using the rm command to clean up worked.

According to the bug report, this should've been fixed a long time ago. 
  I thought it was worth pointing out here since I cannot reopen the bug.
