Wouldn't surprise me.  Since this is seen as a P2P product (EarthV), they may be resetting it.  It's simple for them to make an exception if they choose.  Just allow EarthV-HTTP to pkg.opensolaris.org at whatever bandwidth they choose (preferably the same as HTTP!).  But getting an ISP to do this....
