Let's not exaggerate the parallels.  The US Constitution is 219 years
old; the OpenSolaris constitution is about 1% that old.  We are trying
to figure out what works best, and in so doing, we are occasionally
being liberal about the interpretation and in other case explicitly
ignoring it, but always with the *explicit* understanding that we
will revise the constitution by the end of our term (at the latest)
to reflect what we have empirically determined works best.  There is
a huge difference between that sort of open development exercise and
blatantly ignoring the rule of law and the civil rights of the governed
in a long-established republic.
