This is surprising to me.
IMHO it is not entirely practical to assume that significant distros
can be
created based off a binary repository of another distro. Any distro worth
it's meat ultimately needs to build from source.

In the end the source is out there. There is just a need for other
distros
evolving to have significant impact/value in the market which can in turn
have effects on how official things are done. There is nothing stopping
technical progress from brilliant minds in the community - from this
perspective the trademark issue is not significant. If you can't
state things
explicitly you imply, but there is no reason to stop innovating.
